General Terms and Conditions (GTC)
§1. General These conditions exclusively apply to the lessons. By participating in the lessons, the student declares that they have been informed about the General Terms and Conditions and fully agree to them. Changes and amendments to this contract require written form. The clause requiring written form can only be modified or canceled in writing. The legal invalidity of individual contract parts does not affect the validity of the remaining contract parts.
§2. Lessons, Vacations, and Holidays During public holidays, official school holidays in North Rhine-Westphalia, and Rose Monday, there will be no lessons. Please note that these holidays are specific to the region of Germany. The agreed fee for lessons remains unaffected by these cancellations.
§3. Cancellation of Lessons / Illness The student agrees not to attend the lessons if they are contagious and pose an immediate risk of infection to the instructor. The canceled or missed lessons by the student do not need to be made up (§ 615 of the German Civil Code). The corresponding remuneration cannot be deducted from the fee. In case of extended illness (with a medical certificate) of the student, the prorated fee is waived after six weeks. In case of extended illness of the instructor, the prorated fee is waived after two weeks. Missed lessons due to other hindrances of the instructor (e.g., concerts, further education, etc.) will be rescheduled in consultation with the student. In this case, there is no entitlement to make up the missed lesson at a specific time. The instructor will attempt to offer two different rescheduling options. In the event of lesson cancellations due to force majeure, pandemics, or public bans, in-person lessons will be replaced with online lessons. No refunds of course fees will be provided in these cases.
§4. Termination The lesson contract can be terminated four times a year, each time by the end of May 31st, August 31st, November 30th, and February 28th. The termination must be received in writing, at the latest four weeks before the end of a quarter. In case of termination by mail, the postmark serves as the date of receipt.
§5. Responsibilities of the Instructor / Responsibilities of the Student The instructor conducts the lessons with full responsibility for proper and regular instruction. The student agrees to attend the lessons regularly and practice as necessary at home.
§6. Trial Period The first four weeks of all group offers are considered a fee-based trial period. Only after the trial period has expired and the registration is signed, the lesson contract is concluded. If the student decides to withdraw from the group during the fee-based trial period, there is no entitlement to a refund of the already paid fee.
§7. Supervision Supervision is only provided during the lessons. The student or their legal representative is responsible for transportation to and from the lessons, as well as waiting times before and after the lessons. The student or their legal representative is liable for personal, material, and property damages resulting from participating in the lessons.
§8. Year-End Summary At the end of the calendar year, the student or their legal representative can request a summary of the completed hours. If less than 36 hours were provided by the instructor, the difference will be refunded or credited.
§9. Payment Default In case of a one-week payment default, a reminder will be sent as a message or via email without incurring any fees. In case of a two-week payment default, a late fee of 5 euros will be charged.
§10. Family Discount For a second enrollment/second instrument or subject, or for additional family members' enrollment, the lesson fee for the second child/person is reduced by 10 euros.
§11. Bringing Siblings to Lessons Bringing non-registered siblings to the lessons is only permitted in exceptional cases and with prior agreement with the respective instructor. If the sibling can be integrated into the lessons based on their age, a participation fee equal to the respective hourly rate is to be paid directly to the instructor during the lesson.
§12. Other Agreements Valid in Writing Only.
§13. Online Lessons The student acknowledges that online lessons may be conducted as part of the instruction. The student is responsible for ensuring a stable internet connection and suitable equipment for participating in the online lessons.
§14. Lesson Absence / Technical Issues If the student is unable to attend an online lesson due to technical issues on their side, the lesson will not be rescheduled, and the fee remains payable. If the instructor is unable to conduct the online lesson due to technical issues on their side, the lesson will be rescheduled at a mutually agreed time.
§15. Liability The instructor is not liable for any damages or injuries incurred during the online lessons. The student is responsible for ensuring a safe and appropriate learning environment during online lessons.
§16. Data Protection The student agrees to the storage and processing of their personal data for the purpose of contract fulfillment. The data will not be disclosed to third parties unless there is a legal obligation to do so.
§17. Changes to the Terms and Conditions The instructor reserves the right to change the terms and conditions as needed. The student will be notified of any changes in writing and has the right to object to the contract.
§18. Severability Clause If any provision of these conditions is or becomes invalid in whole or in part, the validity of the remaining provisions shall not be affected.
§19. Contract Duration The lesson contract has an indefinite term and can be terminated by both parties by adhering to the notice period as specified in §4.
§20. Written Form Changes and amendments to this contract require written form.
